If you are passionate about singing, we have some exciting news for you! The highly anticipated singing show, “Over The Top Singer,” is set to premiere on the streaming platform SK OVER THE TOP, a family entertainment OTT platform, operated by SKC Productions Private Limited.

Please read the following Standard Terms and Conditions before participating in the Auditions conducted by SKC PRODUCTIONS PRIVATE LIMITED and/or the Production House. These Website Standard Terms and Conditions written on this webpage shall manage your use of our SK OVER THE TOP, a family entertainment OTT platform, Over The Top Singer at www.skottindia.com

These Terms will be applied fully and affect to your use of this SK OVER THE TOP, a family entertainment OTT platform. By using this app, you agreed to accept all terms and conditions written in here. You must not use SK OVER THE TOP, a family entertainment OTT platform if you disagree with any of these Website Standard Terms and Conditions.

Terms & Conditions

Age Requirements

There are no age restrictions for participating in the Over The Top singer event. If you are a minor (usually under 18 years old) and submit content for selection, you must have obtained express consent from your parent or guardian. Your parent/guardian confirms that they have read and agree to be bound by this agreement on your behalf, and they understand their responsibilities regarding your submission.

By registering, the Parent/Legal guardian of the applicant(s)/Participant(s) and the participant hereby agree to the below-mentioned conditions and undertake as follows:

• The ‘Over The Top Singer’ is exclusively for Indian citizens residing in India. Citizens and residents of countries other than India are ineligible to participate.
• To register for the competition, participants need to go to the SK OVER THE TOP, a family entertainment OTT platform and then visit the provided website link. On that website, they should fill out the competition form and upload singing videos as mentioned in the form. This is a necessary step to audition for the competition.
• The participant(s) are required to create and submit a Singing video as a part of registration process for the auditions. This video will be considered as part of the audition process and must showcase the participant’s singing skills and talent. The video must have clear audio quality and at least a basic level of video quality. The duration of the video should not exceed 5 minutes.
• By submitting the singing video, participants grant the organizers the right to use, reproduce, modify and distribute the video for promotional and audition-related purposes.
• There can be a maximum of 1 (one) entry per Participant. In the event of more than 1 (one) entry per Participant, the first Entry received will be taken into account, and the remaining entries will be disregarded.
• Each Entry shall have a single Participant, duo or groups. For groups, the maximum number of individuals permitted for a valid Entry is 5 (five).
• Entries sent after the Audition Period will not be considered for the Program and shall be deemed null and void, with entries beyond the stipulated time at the venue also not being entertained. Any entry forms or supporting materials received via any other method shall be destroyed and will not be considered valid submissions. No exits are allowed until all participant(s)’ auditions or competitions are completed.
• The participant alone will be granted access at the venue. No parents/relatives/friends will be allowed inside the audition venue. Participant should bring one water bottle, medicines required if any and lunch. The Organizer reserves his/her right to change the venue, date and time of the Auditions at its discretion at any point of time.
• The registration does not guarantee the selection or participation of the Applicant in the Audition and such selection shall be as per the sole discretion of Organizer, availability of time and venue. The Applicant/Participant/Guardian shall not raise and waives any right to question the selection process, non-selection of the applicant and/or the selection of any other applicant.
• The applicant(s) should not be bound by any contract or arrangement which may prohibit him/her from entering into a management contract, recording contract and/or merchandising contract or performance contract. With the Organizers.
• In the event that any Participant(s), Judges, celebrities, hosts or performers are unable to perform, attend or appear on the Program due to various reasons, including but not limited to injury, illness or government-mandated lockdowns, the Company reserves the right, at its discretion, to replace or introduce new Participant(s), celebrities, mentors, hosts or performers. Additionally, the Company may disqualify or suspend any Participant(s), celebrities, mentors, hosts or performers as deemed necessary.
• Entry of participant(s) in one stage of audition shall not entitle him/her the entry in subsequent stage of audition. The Company reserves its right to disqualify and/or exclude, in its sole and absolute discretion, any participant from any stage of audition without assigning any reason therefore.
• Participation by anyone shall be rejected, if it is found that the participant(s) have provided wrong information to the Organizer.
• Participant(s) shall follow all directions/rules and regulations framed or given by the Organizers in connection with the auditions.
• Each participant(s) shall participate voluntarily and at his/ her own risk and will have no claim against Organizers on any account whatsoever in relation to the said contest. The Organizers shall not be responsible for any damage, loss or any form of physical or mental harm or injury caused to the Participant/guardian.
• For the purpose of participation, all expenses if any, including traveling cost and expense incurred in sending SMS shall be borne by the participant(s).
• The participant(s) agrees, confirms and warrants that he/she shall have no right, title, interest or other claim whatsoever over his performance/work/photos submitted or created during the audition and the copyright in the same shall vest with the Organizer in perpetuity for the entire world. Organizer will have the right to use photographs, cut outs, information pertaining to the Artist, shoot reality bytes from/related to participant(s), his/her friends and family members, personal photographs and other available information.
• The contest may be discontinued or terminated by organizers at any point of time without assigning any reason thereof.
• Winner(s) and/or persons accompanying him/her shall travel at their own risk and shall take appropriate medical Insurance at their own cost.
• Winners may be required to sign an “indemnity and release of claims” form, releasing SKC from liability. Failure to comply may result in disqualification and selection of an alternate Winner.
• Participants must not post profanity or abusive comments on the company page or website. Violators will be disqualified and SKC reserves the right to take legal action.
• The participant(s) agree to provide and/or complete any necessary documents as deemed appropriate by the Organizer to fulfill their obligations under the contest and/or these Terms and Conditions.
• The Organizers reserves the right to modify the rules and/or the terms and conditions from time to time without any prior/public notice by posting the applicable terms and conditions on its website or otherwise.
• Organizer shall not be responsible in any circumstances for the non-fulfillment of commitments/obligations of Third Party.
• The decision of the Organizers shall be final and binding on the Participant. No disputes regarding the participations/rejection/broadcast or rights of the participants will be entertained at any point of time.
• The Organizer is not liable to the winner(s) for the cancellation, discontinuation and/or postponement of the audition or Program.
• Organizer shall not be bound or the participant(s) shall not be entitled to any remuneration fee, reimbursements of cost or any payments of whatsoever nature for the work done.
• All participants are expected to maintain fair play, respect for fellow participant and professionalism during the all rounds of auditions and Competitions.
• All rights the participants/guardian agree that reserved by Organizers only

Over the Top Singer Online Registration Process

You can also register yourself online for Over the Top Singer auditions. In order to register yourselfonline for auditions, follow these easy steps –

• Go to www.skottindia.com or download the SK OVER THE TOP, a family entertainment OTT platform.
• After downloading, register yourself or log in to an already registered SK OVER THE TOP, a family entertainment OTT platform account.
• After that, click on Over The Top Singer Auditions banner.
• Then you will be asked to choose a language.
• After that, you will be given all the terms and conditions. Accept those and submit them.
• It will ask you to fill your form with details like name, age, email, postal address, id proofand most important of all a Singing video.
• So after uploading the video.
• Once You have completed filling details of Participant’s Personal Information, You shall carefully read the Terms and Conditions available at SK OVER THE TOP, a family entertainment OTT platform and click the checkbox ‘I Accept the Terms & Conditions’ in order to accept the Terms and Conditions.
• In this way, you will get registered for the show online. This video will be considered as part of the audition process. So on the basis of that video; you will be called for further venue auditions.
• You shall click on “Request OTP” & click on “Submit” in order to submit the Entryand you may receive a One Time Password (OTP) message on the mobile number submitted by you. If your Entry has successfully been submitted, you will receive a pop-up notification on the entry submission page. In the event you fail to verify/authenticate the validity of Your mobile number or the mobile number by You is found to be false or the said mobile number is not registered in the Participant’s andParent’s name, then the Company shall have the right to forthwith disqualify the Participant from further participation and his/her Entry shall immediately be considered to be null and void. Company shall not be responsible in that event.

As this video is the first and most important step for auditions, so let us know about the measures to betaken in order to make this Singing video.

• Participants interested in Over The Top Singer auditions can upload up to 2 videos in the audition form.
• During video recording, ensure your face is properly displayed without any modifications.
• Choose a quiet and stable location for recording, avoiding noise and shaking.
• Your video must be 5 min maximum.
• The size of the video must be less than 50 MB.
• The format of the file can be mp4, mpg or MPEG form.
• You have to upload the video on the application form itself.

Online Registration

Participants are required to voluntarily register in the Auditions by following the procedure set out in these Terms and Conditions. Each participant is allowed only one entry during the online registration process. If multiple entries are submitted, only the first entry received will be considered, and any additional entries will be disregarded. Entries received after the online Registration Period will not be considered for the Auditions and shall be deemed null and void. The Company shall not be responsible for any Entries submitted, whether correctly or not, but not received due to any reason whatsoever. It shall be your sole responsibility to ensure that the Entry is submitted correctly after following the due procedure specified by the Company hereunder and Terms and Conditions prescribed herein.

Audition Process

The First Round Audition

To successfully pass the Over the top Singer First Audition round, candidates must impress the judges. Only upon impressing the judges will they be granted the opportunity to proceed to the second round.

• In the First round, participant will have a maximum of 5 minutes to showcase their talents to the judges. If they succeed in impressing the judges, they will qualify for the second round.
• The Company’s decision regarding the composition of the judges is final and binding on you and the Participant(s). You shall not be entitled to dispute and/or challenge the composition or the decision of the judges at any time in connection with the selection procedure, to the maximum extent permitted by law. Judge composition may vary during the Auditions.
• The Participant(s) shall be evaluated and shortlisted by the Judge based on their singing skills and unique singing style. The judging criteria may include vocal quality, pitch accuracy, stage presence, originality and overall performance or any such other criteria determined by the Company at its sole discretion.
• Based on the evaluations of the Audition Clips by the Judge, the top-rated performances shall be shortlisted and the Participants shall be selected and eligible for participation in second round of the Auditions. The Company reserves the right to select any number of Participant(s) from the First Round Auditions to participate and perform in Second Round of the Auditions.
• Participants shortlisted for Second round will be notified via email. If no response within 24 hours, attempts will be made to contact them up to three times via provided contact information. The communication from the Company shall provide essential details about the next audition round, including the date and time. Upon receiving this communication, you are obligated to confirm the participant’s participation in the second round Auditions and make necessary arrangements before the auditions.
• It is clarified that the Company is under no obligation to communicate to the Participants who have either been disqualified or have not been shortlisted for Second round Auditions.
• The Participant shall not be eligible for the Second round Auditions and shall consequently be disqualified.

The Second Round Audition

To successfully pass the Over the Top Singer Second Audition round, candidates must impress the judges. Only upon impressing the judges will they be granted the opportunity to proceed to the Third round.

• First round shortlisted participants must attend Second round Auditions at the designated Audition Centre in (City) on dates and times set by the Company.
• Selected participants from the first round will compete in the Second Round during the second round auditions. The judges will evaluate the performances in the Second Round and the best performer will be chosen to advance to the third round of the auditions. The decision of the judges in selecting the best Singer is final and binding.
• During the Second round, participants will be evaluated and shortlisted by the Judge based on the same criteria as in the first rounds.
• Participants not selected as the best Singer in the Second Round will not be eligible for further advancement in the audition process of Over The Top Singer.
• All Third round shortlisted participants will be notified on the same day as the Second round audition through various communication methods determined by the Company. Participants and Parents are responsible for being available and checking for updates. The communication will provide details for Third Round Auditions and participants must confirm their participation and make necessary arrangements in advance.

The Third Round Auditions (Televised)

In the third round of auditions, the judges will select the top 12 contestants based on their singing performance. Now the journey of the participants will start.

• Second round shortlisted participants must attend Third round auditions at the designated Audition Centre in (City) on dates and times set by the Company.
• The judges will evaluate the performances in the third round. The best performer will be chosen as one of the top 12 participants to continue in the competition. The decision of judges is final and binding.
• During the third round, participants will be evaluated and shortlisted by the Judges based onthe same criteria as in the first and second rounds.
• Participants not selected as one of the top 12 in the third round will not be eligible to continue on the Over the Top Singer show.
• The selected Top 12 Participants(s) shall have to ensure that they will make themselves available for all shoot dates and travel to any place for the shoot of the Program, as may be informed by the Company and/or Production House from time to time.
• It is clarified that you shall be solely responsible to make all arrangements for facilitating the Audition Clips and/or Presentation and/or Showcase and the Company shall not be responsible to provide the same.

Use of the Site:

• You are granted a limited license to access and make personal use of this site, but not for commercial purposes, unless expressly authorized by SK Over The Top.
• You may not reproduce, modify, sell or exploit any part of this site without express written consent from SK Over The Top.
• The digital media download and streaming services on this site are for personal and non-commercial use only.
• You may not capture, copy or download previews or full song streams without permission.
• You may not frame or use framing techniques to enclose any trademark or logo of SK Over The Top without permission.
• You may not use any Meta tags or hidden text utilizing SK Over The Top’s name or trademarks without permission.
• You are granted a limited right to create a hyperlink to SK Over The Top’s home page, provided it is not misleading or offensive.

No warranties

This Website is provided “as is,” with all faults, and Over The Top Singer express no representations or warranties, of any kind related to this Website or the materials contained on this Website. Also, nothing contained on this Website shall be interpreted as advising you.

Limitation of Liability

In no event shall Over The Top Singer, nor any of its officers, directors and employees shall be held liable for anything arising out of or in any way connected with your use of this Website whether such liability is under contract. The Over The Top Singer, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

Indemnification

You hereby indemnify to the fullest extent Over The Top Singer from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

Assignment

Over The Top Singer is allowed to assign, transfer and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

Account Maintenance and Responsibility:

You are responsible for maintaining the confidentiality of your account and password. SK Over The Top is not liable for any loss or damage resulting from your failure to comply with account obligations. You may cancel your account or notify SK Over The Top of any unauthorized use.

Governing Law:

These Terms and Conditions are governed by the laws of India.
